SUPERIOR COURT OVERRULES PRESUMPTION AGAINST HOMOSEXUAL PARENTS
Since 1985, Pennsylvania law required trial courts to favor heterosexual parents by an evidentiary presumption that required homosexual parents to prove that there would be no harm to the child. In MAT v. GST, the Superior Court overruled prior caselaw on that issue and now requires the trial court to determine custody on the basis of the best interests of the child.
